This is the case when the custody of a minor is entrusted to an adult who is not the parent of the minor. Accordingly, the guardian is legally vested with the power and duty to care for the minor. Many parents entrust guardianship of their child to a family member so that the child can be covered by the guardian`s health insurance or to allow the child to enroll in another school district. Any parent considering transferring guardianship of their child to another person should remember that guardianship is custody. So if you give guardianship of your child to someone else, you hand over custody to the guardian. As a parent, you have legally lost custody and control of your child. A guardian could technically leave Guam and take your child with them without your permission. You should therefore carefully consider the reason for the guardianship and ensure that you fully trust the proposed guardian(s). Once the petition is submitted, the matter will be scheduled for a hearing. This includes preparing documents and a court hearing. Fortunately, the Supreme Court does not charge fees for cases involving minors. The proposed guardian must submit an application for guardianship over a person with a disability, explaining the need for guardianship. The petition must include a letter from a physician examining the disability and the fact that because of the disability, the person is “unable to properly manage and care for their property without assistance, and for this reason is likely to be deceived or forced by clever or design people.” In addition, an inventory of the person`s property, debts and sources of income must be submitted to the court. If the guardianship is approved, the guardian must submit an annual statement of income received and the various invoices paid on behalf of the person with a disability.
